1 1. Description of Service

CharmAI is an AI-powered dating and conversation assistant that provides:

• Reply Suggestions: AI-generated response options in multiple tones (flirty, sincere, funny, confident, spicy) based on conversation screenshots you upload.
• Chat Analysis: Detailed analysis of WhatsApp chat exports or screenshots including interest levels, compatibility scores, red/green flags, attachment styles, and conversation dynamics.
• AI Coaching: An interactive AI coach you can chat with to get personalized dating advice based on your specific conversations.
• Multi-language Support: The App is available in English, French, Spanish, and German.

2 2. Eligibility

You must be at least 18 years of age to use CharmAI. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. CharmAI is designed for adult dating and social interaction purposes. If we discover that a user is under 18, we will immediately terminate their account.

3 3. Account Registration

To use certain features of CharmAI, you must create an account. You agree to:

• Provide accurate and complete information during registration.
• Keep your account credentials secure and confidential.
• Notify us immediately if you suspect unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4 4. Subscriptions & Payments

Free Tier: CharmAI offers a limited free tier that includes up to 15 reply generations per day. Free users have access to basic features with usage limits.

CharmAI Premium: Premium subscribers enjoy unlimited reply generation, unlimited AI coaching chats, all reply tones and styles, and priority response speed.

Payment Processing: All payments are processed exclusively through the Apple App Store (iOS) or Google Play Store (Android). CharmAI does not directly process or store any payment information.

Subscription Plans:

• Weekly subscription with optional 3-day free trial
• Annual subscription with discounted pricing

Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage and cancel your subscription through your device's App Store or Play Store settings.

Refunds: Refund requests are handled by Apple or Google according to their respective refund policies. CharmAI does not directly issue refunds.

Price Changes: We reserve the right to change subscription pricing. Existing subscribers will be notified in advance and given the option to cancel before new pricing takes effect.

5 5. AI-Generated Content

You acknowledge and agree that:

• AI-generated suggestions may not always be accurate, appropriate, or suitable for your specific situation.
• You are solely responsible for deciding whether and how to use any suggestion provided by the App.
• CharmAI is not a substitute for professional counseling, therapy, or relationship advice.
• We are not responsible for any outcomes, positive or negative, that result from using our AI suggestions in your personal interactions.
• AI analysis results (interest levels, compatibility scores, red/green flags) are estimates based on text patterns and should not be taken as definitive assessments of another person's feelings or intentions.

6 6. Acceptable Use

You agree NOT to use CharmAI to:

• Harass, stalk, intimidate, or threaten any person.
• Generate content that is abusive, hateful, discriminatory, or promotes violence.
• Manipulate, deceive, or emotionally exploit others.
• Upload content involving minors in any dating or romantic context.
• Upload content that you do not have the right to share (e.g., someone else's private conversations without their knowledge).
• Attempt to reverse-engineer, decompile, or extract the source code of the App.
• Use automated tools, bots, or scripts to access or interact with the App.
• Circumvent usage limits, subscription requirements, or security measures.
• Use the App for any illegal purpose or in violation of any applicable laws.

Violation of these guidelines may result in immediate account suspension or termination without refund.

7 7. User-Uploaded Content

When you upload screenshots or chat exports to CharmAI:

• You represent that you have the right to share this content for the purpose of AI analysis.
• You understand that conversation data is processed in real-time and not permanently stored on our servers.
• You acknowledge that you are responsible for any content you upload and its implications.
• We reserve the right to refuse processing content that violates these Terms.

We respect the privacy of all parties in uploaded conversations. We strongly encourage you to use CharmAI ethically and with respect for all individuals involved.

8 8. Intellectual Property

All content, features, functionality, design, code, graphics, logos, and trademarks within CharmAI are owned by Gaboul Tech Studio and are protected by international copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, distribute, or create derivative works based on the App.
• Use our trademarks, logos, or branding without prior written permission.
• Reproduce or redistribute any part of the App for commercial purposes.
• Claim ownership of AI-generated content produced by the App's systems.

You retain ownership of the conversation content you upload. We claim no ownership over your personal messages or screenshots.

9 9. Disclaimers

CharmAI is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Guarantees that the App will be uninterrupted, error-free, or secure.
• Accuracy, reliability, or completeness of AI-generated content.
• Results or outcomes from using the App's suggestions in personal interactions.

We do not warrant that the App will meet your expectations or that any errors will be corrected.

10 10. Limitation of Liability

To the maximum extent permitted by applicable law, Gaboul Tech Studio and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, use, goodwill, or other intangible losses.
• Damages resulting from your use of or inability to use the App.
• Damages resulting from any interactions or relationships influenced by AI suggestions.
• Unauthorized access to or alteration of your data.

In no event shall our total liability exceed the amount you have paid to us in the 12 months preceding the claim.

11 11. Indemnification

You agree to indemnify, defend, and hold harmless Gaboul Tech Studio from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of a third party.

12 12. Termination

We reserve the right to suspend or terminate your account and access to CharmAI at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to:

• Violation of these Terms of Service.
• Abusive, harmful, or illegal use of the App.
• Failure to pay subscription fees.
• Request by law enforcement or government agencies.

Upon termination, your right to use the App ceases immediately. You may cancel your account at any time by contacting us. Active subscriptions should be cancelled through your App Store or Play Store settings to avoid further charges.

13 13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the App or by other means. Your continued use of CharmAI after the revised Terms become effective constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the App and cancel your subscription.

14 14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Gaboul Tech Studio operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of CharmAI shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the competent courts of the applicable jurisdiction.
